The Brexit Papers

The Brexit Papers: Third Edition offer Government, parliamentarians, the media and the public a concise and informative evaluation of the legal challenges posed by leaving the EU, and their practical implications for the economy and society.

They offer a series of recommendations to Government, and each can be read as a stand-alone document.

Concise and written in plain English, the papers are written by members of the Brexit Working Group, Specialist Bar Associations and other senior barristers.

The Brexit Papers first emerged following a roundtable meeting with civil servants from across Government to discuss how Brexit would impact different areas of law and build on the work the Bar Council undertook on these issues in advance of the referendum.

This third edition represents an expansion of the legal fields covered, which now include acquired rights, WTO, agriculture, fisheries, product standards, public procurement, environment, dispute resolution and the CJEU.

The Brexit Working Group

Chaired by Hugh Mercer QC, the Brexit Working Group was set up by the Bar Council in 2016 to examine the complex issues arising from Brexit and to help the Government identify the legal and constitutional priorities. The group draws on the combined expertise and experience of the profession across a wide range of practice areas.
